Introduction

Welcome to Methodic Labs, Inc. (“Methodic,” “we,” “our,” or “us”). These Terms of Service ("Terms") govern your use of our multi-employer platform, which connects users (employees or members) with job opportunities provided by multiple employers. By accessing or using our platform, you agree to comply with these Terms. If you do not agree with these Terms, do not use the platform.

Our Role as a Multi-Employer Platform

Methodic provides a technology platform that facilitates job matching between users and employers. Methodic does not employ users directly and is not responsible for hiring decisions, payroll, benefits, taxes, or other employment-related obligations. Employers on the platform are solely responsible for compliance with applicable employment laws.

Employment Data & Privacy

We collect and share **employment-related data** to help match users with job opportunities. This may include work history (e.g., start and end dates, shifts completed, job roles), job preferences, availability, compensation, and geo-location. **Identifiable information will only be shared if the user provides explicit consent.** Otherwise, data is shared in an anonymized format. AI-Driven Scheduling & Fairness in Shift Assignments

Methodic uses AI-based scheduling to match users with job opportunities efficiently and fairly.

Scheduling and job prioritization are based on:

- **User Preferences & Availability** – AI schedules shifts based on users’ selected job types, hours, and location preferences.

- **Time of Service** – Users who have demonstrated consistent engagement on the platform may receive priority scheduling.

- **Performance Metrics** – Reliability, attendance history, and employer feedback may influence prioritization.

- **Engagement with the Platform** – Users who frequently accept assignments and engage with the app are prioritized.

We are committed to fairness in scheduling. No decisions are made based on protected characteristics such as race, gender, or age. Users may update their preferences at any time to adjust how they receive job opportunities.

User Responsibilities

Users must provide accurate information regarding their availability, job preferences, and work history. By using the platform, users agree to:

- Only apply for jobs they are qualified for.

- Honor accepted job assignments and comply with employer policies.

- Maintain professionalism and abide by workplace rules.

- Update their availability to ensure job listings are accurate.

- Not engage in fraudulent, deceptive, or inappropriate behavior on the platform.

Employer Responsibilities

Employers using Methodic must:

- Post accurate job descriptions, including work requirements and compensation.

- Ensure compliance with all applicable labor laws.

- Communicate clearly with job candidates and respond to inquiries.

- Handle all aspects of employment, including hiring, payroll, taxes, and benefits.

- Not use the platform to discriminate or violate labor laws.

Account Registration & Security

Users must create an account to access the platform. Account credentials must be kept confidential. Methodic is not responsible for unauthorized access due to compromised credentials. If you suspect unauthorized use, contact us immediately at legal@methodic.work.

Payments & Compensation

Methodic does not process payroll or employment payments. Compensation for work performed is managed entirely by the employer. Users should direct all payroll, tax, and employment-related inquiries to their respective employers.

Dispute Resolution & Arbitration

Any disputes between users and employers must be resolved directly between the parties. Methodic is not responsible for resolving employment disputes. If a dispute arises involving the use of the platform itself, users agree to resolve it through binding arbitration rather than litigation, except where prohibited by law.

Appeals & Scheduling Disputes

Users who believe they were unfairly scheduled or deprioritized may submit an appeal through the Methodic support team. Appeals will be reviewed based on:

- Platform activity and engagement history.

- Any errors in AI-based scheduling.

- Consistency with fairness policies.

Final decisions will be made based on an internal review process to ensure equitable outcomes.

Termination & Account Suspension

We reserve the right to terminate or suspend user accounts if they violate these Terms, engage in fraudulent activities, or misuse the platform. Termination does not waive any obligations incurred prior to termination.

Limitation of Liability

To the extent permitted by law, Methodic is not liable for any indirect, incidental, or consequential damages related to job placements, employment disputes, or misuse of the platform. Our maximum liability for any claim is $100

Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of the platform after changes are made constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of California, unless otherwise required by law. Any disputes not subject to arbitration will be handled in the courts of Alameda County, California.
